Where does a photovoltaic obligation apply for industry & commerce?

Stand: 24.06.2025. Die aktuelle Bundesregierung hat eine generelle bundesweite Photovoltaik-Pflicht mit einheitlichen Regelungen für private und gewerbliche Neubauten im Koalitionsvertrag vereinbart. Bisher ist es aber noch nicht soweit und in den verschiedenen Bundesländern gelten unterschiedliche Bestimmungen für Industrie und Gewerbe. Hier eine Momentaufnahme mit einer Länder-Übersicht.

The goal is clear and was Climate Protection Act (KSG) Germany is to become climate-neutral by 2045. By 2030, 80% of the total electricity requirement is to come from renewable energies. As a result, following the amendment to the KSG in August 2021, various federal states have made photovoltaics mandatory for the sealing of new commercial areas and, in some cases, for the renovation of commercial roofs or existing buildings.

In Baden-Württemberg, photovoltaic systems have had to be installed in new commercial buildings since 2022 and in roof renovations since 2023. Hamburg has been following suit for renovations since 2024 and Lower Saxony is planning to do so in 2025. Schleswig-Holstein has adopted these two measures since 2023 and in North Rhine-Westphalia and Hesse, photovoltaic systems have been mandatory for new buildings on public properties since this year. PV systems for industry and commerce have been mandatory for new buildings in North Rhine-Westphalia since 2024. In Berlin, Hamburg, Rhineland-Palatinate and Lower Saxony, they are already mandatory for new roof areas of companies and in Bavaria from mid-2023. The Free State will also follow suit for new residential buildings from January 2025. In Brandenburg, it has been mandatory to install photovoltaics on new factories and office buildings since 2024. It is already being planned for roof renovations. The Bremen parliament adopted the same measures in mid-March 2022. It will start doing so for new buildings in May 2023 and for roof renovations in mid-2024.

In Schleswig-Holstein, North Rhine-Westphalia, Rhineland-Palatinate, Hesse and Lower Saxony, there is currently a solar obligation for the construction of new large parking areas on company premises. As with roof areas, each federal state currently has different regulations on the ratio of sealed area to the size of the photovoltaic system to be installed. Plans for similar measures are on the negotiating table in Bremen and Saxony. The state governments in Saxony-Anhalt, Thuringia and Mecklenburg-Western Pomerania are still discussing various models for a mandatory photovoltaic system. It is to apply to large parking lots and commercial roof areas. Since May 2024, Saarland has been planning a large solar program with photovoltaic obligations for commercial parking spaces. In Brandenburg, all new parking lots with more than 35 parking spaces have been equipped with solar systems since 2024. France, for example, is much further ahead here. By 01.07.2023, all existing and newly built large parking lots with parking spaces for at least 80 cars should even be equipped with PV systems.
