The Federal Network Agency has set the date of October 1, 2026 as the MiSpeL determination Decided. Battery storage systems and bidirectional charging points may therefore use grid power and power from renewable installations mixed together without losing the EEG subsidy. Status of this contribution: October 8, 2026.
The most important information about the MiSpeL determination shortly
- MiSpeL stands for Market integration of storage facilities and charging points. The determination bears the file number 618-25-02
- Storage systems can use electricity from renewable sources and the grid mixed store. In this case, the EEG market premium is also paid for stored renewable electricity.
- If stored network power is fed back, the amount of power dropped will be Levies and network charges on the net settlement, because the quantities are settled
- The Accrual option is open to all users, including those who do not have a supported EE system and who do not generate their own electricity. The Package option On the other hand, it is aimed at solar systems up to 30 kWp
- Until 30 September 2027 However, the application is only possible with the consent of network and metering station operators. The flat-rate option also requires the EU Commission’s aid approval.
- For industry, the Federal Network Agency explicitly lists storage facilities to smooth electricity consumption, against high power prices, and for net metering benefits under § 19, paragraph 2 of the StromNEV. Such storage facilities can also parallel for arbitrage to be used
What is the MiSpeL setting?
The MiSpeL determination is a decision of the Federal Network Agency (BNetzA) regarding Market integration of storage facilities and charging points. It regulates how the amounts of electricity generated by a storage system or a bidirectional charging point are determined and verified when it receives both electricity from an renewable energy installation (EE installation) and electricity from the grid. The legal basis is § 85d of the EEG and § 62(2) of the EnFG.
The core problem is described by the BNetzA as follows: Electrons do not have a name tag. When grid power and solar power flow into the same battery, they mix together. Therefore, until now, storage systems were only allowed to store green on-site electricity if the EEG subsidy was to remain in place. MiSpeL finally solves this problem by measuring in quarter-hour increments and using fixed calculation formulas.
What does the MiSpeL regulation from October 1, 2026 regulate?
The establishment opens in addition to the current Exclusivity option two new ways: the Accrual option in accordance with § 19, paragraph 3b of the EEG and the Package option in accordance with § 19, paragraph 3c of the EEG. To this end, it provides formulas and measurement concepts for typical case scenarios in two annexes. In addition, it requires network and measurement station operators to enable the use within the scope of their duties (Article 7).
„The MiSpeL regulation is urgently needed in the market,“ says BNetzA President Klaus Müller. Compared to the consultation draft of September 18, 2025, the authority has changed the following points in particular:
- Monthly reconciliation: In the demarcation option, the calendar month is the consolidation period, no longer the calendar year as previously in the draft.
- Extended scope of application: The demarcation option applies even without a supported EE installation, that is, with non-supported installations, with non-EE installations such as CHP or without any own generation at all.
- Solutions with only one counter: In addition, a counter is sufficient for co-location storage, purely network-connected storage, and storage without any other generation in the demarcation option.
- Custom rules for the industry: A special case also regulates storage in companies under the special compensation scheme.
What changes will there be for battery storage systems compared to what is currently available?
In the exclusivity option, an EE power storage device may not charge while electricity is being drawn from the grid. However, this barrier is removed with the demarcation and flat rate options. This adds two uses, as the overview from the BNetzA shows:
| Optimization of | So far | With MiSpeL |
|---|---|---|
| Self-consumption | possible | possible |
| Grid reference | not possible | now possible |
| EE marketing | possible | possible |
| Arbitrage | not possible | now possible |
So far: Exclusive option with EE power storage. With MiSpeL: Separation and lump sum option. Source: Federal Network Agency, workshop slides on MiSpeL determination from October 2, 2026, slide 18
Optimizing grid access means storing energy during times of low electricity prices. Optimizing EE marketing, on the other hand, means feeding energy into the grid during times of high prices. Arbitrage ultimately exploits the price difference between grid access and subsequent back-feeding.
Important: However, the new options only apply in the Direct marketing. Therefore, they are not available with feed-in tariff.
Boundary option or lump-sum option: Which one suits your location?
In short: For industrial and commercial sites with solar systems of over 30 kWp or completely without solar systems, only the zoning option is available. The flat-rate option, on the other hand, is a simplification for small home-based solar systems and small businesses.
| Feature | Boundary option | Package option |
|---|---|---|
| For whom | Plants of all types and sizes, including those without a supported EE installation | Solar systems up to 30 kWp with storage or bi-directional wallbox, for home use and small businesses |
| Measurement | Quarter-hour accuracy; usually two digits, in special cases one | A quarter-hour-accurate meter at the house connection |
| Determination of quantities | Exactly according to the formula, consolidation per calendar month | Package; grid feed-in is considered eligible up to 500 kWh per kWp |
| Useful | From entry into force; until 30.09.2027, subject to agreement with network and metering station operators | No earlier than the month following the EU aid approval for § 19, paragraph 3c of the EEG; until 30.09.2027, additionally in agreement with network and metering station operators |
| Legal basis | Section 19, paragraph 3b of the EEG, Section 21, paragraphs 1 to 4 of the EnFG | Section 19, paragraph 3c of the EEG, section 21, paragraph 4a of the EnFG |
However, the two options cannot be combined at the same feed point.
What does the MiSpeL standard mean for battery storage systems in industry?
The regulation explicitly targets electricity-intensive companies. According to the BNetzA, these companies install battery storage systems, for example, to smooth out electricity supply, avoid high additional power prices and achieve the net tariff subsidies under § 19, paragraph 2 of the StromNEV. MiSpeL now enables the integration of such storage systems into the market and their parallel use „e.g. also for arbitrage purposes“. Our page shows how these applications can be combined. Multi-use with battery storage.
Companies with special compensation arrangements
Companies under the special compensation scheme (BesAR, §§ 28 ff. EnFG) may also claim the allowance privileges under § 21 EnFG for arbitrage and the associated storage losses. To do this, the regulation provides for a special case (A9). Because different levels of allowances apply for the connection to the network of these companies, the amount returned is calculated using the lowest applicable allowance value. Therefore, trading against allowance differences is not profitable.
Sites with storage but no own production
For sites with storage and other consumption, but without PV systems or other generation, MiSpeL provides for a simplified case (Special Case A11). Here, a quarter-hour accurate bidirectional counter is sufficient. The entire net power input is considered to be debitable; however, it reduces the charges by a maximum of the amount of the grid connection fee. In this case, however, storage losses are not privileged. Those who wish to claim them therefore use the appropriate basic case with an additional meter.
Excise taxes, network charges and electricity tax
According to the BNetzA, accordingly, there will be less levies and network charges to be paid for returned network electricity. For network charges, this applies under § 118, paragraph 6, point 3 of the EnWG; for the surcharge for special network use, under § 19, paragraph 2, point 16 of StromNEV. Both provisions refer to the charging privileges under § 21 of the EnFG, which the MiSpeL has designed. For § 118, paragraph 6, point 3 of the EnWG, the BNetzA explicitly stipulates that, in its understanding, the reference covers the MiSpeL rules. Furthermore, the electricity tax law also refers to § 21 of the EnFG (§ 11a, paragraph 3 of the StromStV).
The BNetzA, however, attributes the references to network charges and surcharges to the current legal situation until the end of 2028. As of 2029, the AgNes regulation will, however, govern the network charges and the surcharge for special network use. Whether it continues to refer to MiSpeL will be decided only by the AgNes regulation. What this means for the exemption of network charges for new storage facilities can be read in our articles on the AgNes deadlines 2027/2029 and to the FID for battery storage systems.
Requirements at the site
- EE installations behind the feed point must be in direct marketing. Feed-in tariff, tenant electricity surcharge and a commercial purchase by the network operator are excluded, even for CHP installations.
- Anyone who uses the market premium in the demarcation option accounts for the entire net electricity supply in a separate balance sheet account, usually with the direct marketer.
- In addition, all electricity volumes relevant for taxation and subsidies are recorded with quarter-hour accuracy using meters and meters in accordance with the law.
- Storage is generally measured separately from other consumption and other production, unless an individual-meter special case applies.
- New and existing facilities are equally recorded. Existing storage facilities therefore do not need to be commissioned anew.
What applies to co-location storage in solar and wind farms?
The BNetzA explicitly mentions co-location storage alongside a free-standing system or a wind turbine as an application case. The EEG market premium is then also paid for stored solar or wind power, but only for feed-in during periods when the value to be charged is above zero. In negative spot market prices, it usually drops to zero (§§ 51, 51b EEG).
For pure co-location without any other consumption and without a charging point, there is also a simplified case (Special Case A8): One meter is sufficient, and for grid connection, no surcharges are charged as a result. The price of the simplification: The storage losses are deducted from the eligible amount. As a result, the eligible amount is slightly lower than in the more precise basic case with two meters. According to the BNetzA, the simplified case can also be advantageous for systems with DC-side coupling.
For Purely network-connected storage Without generation and without any other consumption, a case with only one meter is also applicable (special case A10). In this case, the net charge burdened by the surcharge is always zero.
Conservation areas must also take two points into account. First, anyone who switches to the demarcation option receives the market premium based on the annual market value instead of the monthly market value. The BNetzA agrees that this disadvantage should be avoided; however, only the legislator can change this. Second, no combination of installations with storage may be connected behind the feed point for which payments are based on the innovation tender.
When does the MiSpeL regulation apply?
The determination takes effect after tenor 8 with its announcement. The BNetzA has waived a later effective date in favor of the greatest possible speed of implementation. Instead, a short transitional period of just under one year applies: Until 30 September 2027 The rules are only applicable if network and metering operators agree. In this time, the parties are supposed to build the IT and billing processes for the mass-market business.

Limits and open points of the MiSpeL definition
- Network fees from 2029: Whether the AgNes designation continues to refer to MiSpeL is still unclear.
- Market communication: The implementation in the processes between network operators, suppliers and direct marketers, on the other hand, is a matter for the 6th decision chamber and not part of MiSpeL. The BNetzA itself has described the transition period for this as being of a relatively short duration.
- Proof of origin: MiSpeL does not preclude the use of quantity determination for proof of origin, but does not regulate the issuance thereof.
- KWK: There is no KWKG funding for stored electricity via MiSpeL. The rules apply only to the storage of electricity from renewable energy sources.
- No change at will: The choice of the formula set is binding and can be changed at the earliest the following year. Simplified formulas are also only permitted if no more precise measurement is available.
- Network bottlenecks: The BNetzA admits that market-driven simultaneity can exacerbate bottlenecks. To remedy this, dynamic network charges via AgNes are intended to be introduced, according to their assessment only from 2030 onwards.
What should companies do now?
- Determining the constellation: First, it is necessary to determine whether the storage system is operated with or without PV, with or without other consumption, and with or without a special compensation control system. This leads to the appropriate formula set.
- Review the measurement concept: Next, check whether quarter-hour-accurate, calibrated meters are present at the correct locations, or whether a single-meter system is sufficient.
- Clarify the form of the sale: If a PV system is located at the site, it must first switch to direct marketing for the feed-in tariff option.
- Involve network and metering station operators early: Until September 30, 2027, their consent is a prerequisite.
- Select direct marketers or suppliers: They control and optimize storage at a quarter-hour rate of the market.
- Securing exemption from network charges: Keep the deadlines of the AgNes reform and the FID requirements in mind for new storage facilities
Brief explanation of the terms used in the MiSpeL definition
- Exclusive option: Previous rule. The storage system only takes power from the EE system and does not simultaneously charge from the grid; only in this way was the EEG subsidy for stored electricity maintained.
- Boundary option: New option under § 19, paragraph 3b of the EEG. Grid power and EE power may be stored mixed; measurement and formula dictate which portion is eligible for support and which is eligible for reimbursement
- Package option: New option under § 19, paragraph 3c of the EEG for solar systems up to 30 kWp. One meter is sufficient, because the feed-in is calculated on a flat-rate basis.
- Salting: Unmetered grid electricity is charged to the grid connection. Accordingly, there are correspondingly fewer levies and network charges to pay.
- Fundable grid injection: The part of the feed-in for which the EEG market premium is paid, i.e., electricity directly from the EE plant and stored EE electricity
- Co-location: In the sense of establishing a storage facility that is connected to generation facilities but without any other consumption behind the same feed point
- Special compensation scheme (BesAR): Exemption privileges for electricity-intensive companies pursuant to §§ 28 ff. of the EnFG
- Value to be adjusted: Reference size of the EEG market premium. If it falls to zero, for example in case of negative spot market prices, there is no market premium for that time period.

Frequently asked questions about the MiSpeL determination
Basics and deadlines
MiSpeL stands for the market integration of storage facilities and charging points. It is a regulation of the Federal Network Agency (No. 618-25-02), adopted on October 1, 2026. It regulates how storage facilities and bidirectional charging points can use grid electricity and electricity from renewable installations mixed together without losing the EEG subsidy.
The determination becomes effective upon its announcement. However, until September 30, 2027, the application is only possible with the consent of network and metering station operators. The flat-rate option is also only applicable from the month following the grant of aid by the European Commission.
Until September 30, 2027, yes: Until then, the rules are only applicable if network and metering station operators agree. After that, this requirement no longer applies. At the same time, network and metering station operators are obliged to enable use.
Yes, in the demarcation and flat-rate options. The EEG market premium is also paid for stored renewable electricity, and for returned grid electricity, levies and network fees are reduced. However, direct marketing is a prerequisite.
The demarcation option precisely determines the amounts of electricity using a formula and is open to all systems. The flat-rate option, on the other hand, flat-rates the input, requires only one meter and applies to solar systems up to 30 kWp.
The demarcation option usually requires two quarter-hour-accurate meters. However, in special cases, one is sufficient, for example in the case of co-location without other consumption, in purely network-connected storage devices, and in storage devices without other generation. For the flat-rate option, a quarter-hour-accurate meter at the home connection is also sufficient.
Industry, network charges and remuneration
Yes. The disconnection option applies even without a subsidized EE installation, with non-subsidized installations, with non-EE installations, and even without own generation. In these cases, EEG subsidies do not exist, but the tariff privileges do.
Yes, for electricity fed back into the grid. Under § 118, paragraph 6, item 3 of the EnWG, the MiSpeL rules, as understood by the BNetzA, also apply to network charges. As of 2029, however, the AgNes regulation will govern the network charges; whether they continue to refer to MiSpeL is uncertain.
Yes. A separate special case governs how BesAR companies claim the benefit of the surcharge under § 21 of the EnFG for arbitrage and storage losses. In this case, the lowest applicable surcharge value is taken into account.
The market premium is also paid for stored solar or wind power, provided the value to be stored is above zero. For storage systems with generation facilities but no other consumption, a meter is also sufficient; as a result, no surcharges are charged for connection to the grid.
Yes. The demarcation option applies to new and existing systems, and existing storage units do not need to be commissioned anew. Existing EE systems, whose market premium has so far been calculated based on the monthly market value, will, however, switch to the annual market value.
No. The demarcation and the flat-rate option require direct marketing. The feed-in tariff, on the other hand, is only provided for in the current exclusive option.
