{"id":10169,"date":"2023-10-09T11:10:38","date_gmt":"2023-10-09T09:10:38","guid":{"rendered":"https:\/\/cubeconcepts.de\/?p=10169"},"modified":"2026-03-24T09:28:43","modified_gmt":"2026-03-24T08:28:43","slug":"les-infractions-a-lesg-et-le-greenwashing-peuvent-couter-cher","status":"publish","type":"post","link":"https:\/\/cubeconcepts.de\/fr\/esg-verstoesse-und-greenwashing-koennen-teuer-werden\/","title":{"rendered":"Les violations ESG et le greenwashing peuvent co\u00fbter cher"},"content":{"rendered":"<p>Le groupe DWS, cot\u00e9 au S-Dax allemand, avait pr\u00e9sent\u00e9 des produits de fonds comme \"durables\" ou plus verts qu'ils ne l'\u00e9taient en r\u00e9alit\u00e9 et a \u00e9t\u00e9 rapidement condamn\u00e9 \u00e0 une amende par l'autorit\u00e9 am\u00e9ricaine de surveillance des march\u00e9s financiers (SEC). <strong>Amende<\/strong> d'un montant de <strong>19 millions d'euros pour des violations ESG et du greenwashing<\/strong> ont \u00e9t\u00e9 condamn\u00e9s. Ils ont en outre \u00e9t\u00e9 condamn\u00e9s \u00e0 une amende de six millions d'euros pour ne pas avoir mis en place des contr\u00f4les suffisants contre le blanchiment d'argent. Dans cette affaire, les seuls frais d'avocat de l'entreprise se sont \u00e9lev\u00e9s jusqu'\u00e0 pr\u00e9sent \u00e0 environ 39 millions d'euros et elle a perdu un milliard d'euros de valeur en bourse. A cela s'ajoutent la perte de r\u00e9putation et, le cas \u00e9ch\u00e9ant, les demandes de dommages et int\u00e9r\u00eats des investisseurs. En Allemagne, l'autorit\u00e9 de surveillance financi\u00e8re BaFin et le parquet enqu\u00eatent encore sur le groupe DWS. Mauricio Vargas, expert financier chez Greenpeace, a d\u00e9clar\u00e9 que \"la d\u00e9cision du tribunal montre clairement que l'\u00e9coblanchiment et la tromperie des consommateurs ne sont pas des peccadilles\".<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les autorit\u00e9s renforcent la lutte contre les violations ESG et le greenwashing<\/h2>\n\n\n\n<p>Die USA greift demnach aktuell h\u00e4rter durch als noch im Vorjahr, als man die US-Gro\u00dfbank Goldman Sachs zu <strong>4 millions de dollars<\/strong> verurteilte. Sie bewarben in ihrer Asset-Management-Einheit des Wall-Street-Instituts zwei ihrer Fonds als \u201eESG-konform\u201c, obwohl weder von ihnen ESG-Standards festgelegt wurden noch Richtlinien oder Strategien dazu existierten. Goldman Sachs hatte sie kurzerhand zu \u201egr\u00fcnen\u201c und \u201enachhaltigen\u201c ESG-Fonds erkl\u00e4rt. In Deutschland wurde Anfang 2022 die Luxemburger Commerz Real Fund Management S.\u00e0.r.l. vom Landgericht Stuttgart (36 O 92\/21 KfH) unter Strafandrohung von 60.000 Euro abgemahnt, ihre irref\u00fchrende Werbung f\u00fcr Nachhaltigkeitsfonds zu unterlassen. Sie hatte mit einer konkreten Auswirkung der Geldanlage in den beworbenen Fonds auf den pers\u00f6nlichen CO\u2082-Fu\u00dfabdruck geworben.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La CSDDD doit constituer le cadre de la CSRD et de la taxonomie europ\u00e9enne<\/h2>\n\n\n\n<p>Le 23 f\u00e9vrier 2022, la Commission europ\u00e9enne a \u00e9t\u00e9 la premi\u00e8re institution de l'UE \u00e0 proposer une <strong>Directive relative \u00e0 la diligence raisonnable en mati\u00e8re de d\u00e9veloppement durable des entreprises (<a href=\"https:\/\/cubeconcepts.de\/fr\/csddd\/\">CSDDD<\/a>)<\/strong> a \u00e9t\u00e9 publi\u00e9e. L'objectif de cette proposition est d'obliger l\u00e9galement les entreprises actives dans l'UE \u00e0 respecter des <strong>Normes en mati\u00e8re de droits de l'homme et de protection de l'environnement<\/strong> dans leurs activit\u00e9s globales <strong>Cha\u00eenes d'approvisionnement<\/strong> et de mieux sanctionner les violations ESG et l'\u00e9coblanchiment. Cette proposition constitue un pas important vers une gestion durable dans des conditions europ\u00e9ennes uniformes et compl\u00e8te les r\u00e8gles existantes ainsi que d'autres initiatives r\u00e9glementaires en cours, telles que la directive sur le reporting en mati\u00e8re de d\u00e9veloppement durable des entreprises (CSRD) avec son <a href=\"https:\/\/cubeconcepts.de\/fr\/droit-de-lenergie\/csrd-obligation-de-rapport-plans-climat\/\">Obligation de rapport CSRD<\/a> et les <a href=\"https:\/\/cubeconcepts.de\/fr\/la-taxonomie-europeenne\/\">R\u00e8glement de l'UE sur la taxonomie<\/a>. Sie soll ab Mitte 2029 f\u00fcr Unternehmen mit mehr als 5.000 Besch\u00e4ftigten und mehr als 1,5 Mrd. Umsatz gelten. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Unifications europ\u00e9ennes jusqu'en 2026<\/h2>\n\n\n\n<p>La CSDDD associe donc les <strong>Obligation de rapport CSRD<\/strong> avec la <strong>Taxonomie<\/strong> et tente d'aligner les r\u00e8glements. Dans l'ensemble, les entreprises devraient s'attendre \u00e0 ce que <strong>Les exigences ESG continuent d'augmenter <\/strong>devenir et <strong>Le greenwashing encore plus s\u00e9v\u00e8rement poursuivi <\/strong>wird. Auch der am 22. M\u00e4rz 2023 ver\u00f6ffentlichte Richtlinienentwurf der EU zu umweltbezogenen Angaben (Green Claims-RL) zielt in eine \u00e4hnliche Richtung. Die CSDDD hat die EU im Februar 2026 mit in die Ver\u00f6ffentlichung der\u00a0<strong>Richtlinie 2026\/470 (Omnibus-\u00c4nderungsrichtlinie)<\/strong> aufgenommen. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Points cl\u00e9s du CSDDD contre les violations ESG et le greenwashing<\/h2>\n\n\n\n<p>Les entreprises, les filiales et les directions seront tenues d'identifier et de signaler les impacts n\u00e9gatifs de leurs activit\u00e9s sur l'environnement et les droits de l'homme tout au long de la cha\u00eene de valeur, et de les minimiser ou d'y rem\u00e9dier. Les grandes entreprises devront d\u00e9velopper une strat\u00e9gie commerciale conforme aux accords de Paris sur le changement climatique et les \u00c9tats membres de l'UE mettront en place des autorit\u00e9s de contr\u00f4le et un r\u00e9seau europ\u00e9en pour \u00e9mettre des injonctions et des recommandations. <strong>Amendes<\/strong> de mieux coordonner les actions. Ici, les victimes peuvent \u00e9galement <strong>de droit civil<\/strong> <strong>contre les entreprises responsables<\/strong> proc\u00e9der.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La CSDDD, une \u00e9p\u00e9e plus tranchante <\/h2>\n\n\n\n<p>Les r\u00e9centes amendes inflig\u00e9es \u00e0 DWS Group et Goldman Sachs pour violation des principes ESG et greenwashing montrent que <strong>que les autorit\u00e9s soient plus strictes<\/strong>. L'UE pr\u00e9voit d'introduire la directive Corporate Sustainability Due Diligence (CSDDD) afin de contraindre les entreprises \u00e0 respecter les normes environnementales et les droits de l'homme dans leurs cha\u00eenes d'approvisionnement et de cr\u00e9er une superstructure contraignante des directives d\u00e9j\u00e0 existantes. <strong>Les grandes entreprises doivent d\u00e9velopper des strat\u00e9gies d\u00e8s maintenant<\/strong>Les entreprises doivent donc s'adapter aux accords de Paris sur le climat.
