Adem\u00e1s, la empresa fue multada con seis millones de euros por no disponer de suficientes controles de blanqueo de capitales. S\u00f3lo los honorarios legales de la empresa en este caso han ascendido hasta ahora a unos 39 millones de euros y ha perdido mil millones de euros de valor en bolsa. A esto hay que a\u00f1adir la p\u00e9rdida de reputaci\u00f3n y las posibles reclamaciones por da\u00f1os y perjuicios de los inversores. En Alemania, la autoridad de supervisi\u00f3n financiera BaFin y la fiscal\u00eda siguen investigando al Grupo DWS. Mauricio Vargas, experto financiero de Greenpeace, explic\u00f3: \"La sentencia judicial demuestra claramente que el greenwashing y el enga\u00f1o a los consumidores no son delitos triviales\".<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Las autoridades adoptan medidas m\u00e1s contundentes contra las violaciones de los principios ASG y el lavado verde<\/h2>\n\n\n\n<p>Die USA greift demnach aktuell h\u00e4rter durch als noch im Vorjahr, als man die US-Gro\u00dfbank Goldman Sachs zu <strong>4 millones de d\u00f3lares<\/strong> verurteilte. Sie bewarben in ihrer Asset-Management-Einheit des Wall-Street-Instituts zwei ihrer Fonds als \u201eESG-konform\u201c, obwohl weder von ihnen ESG-Standards festgelegt wurden noch Richtlinien oder Strategien dazu existierten. Goldman Sachs hatte sie kurzerhand zu \u201egr\u00fcnen\u201c und \u201enachhaltigen\u201c ESG-Fonds erkl\u00e4rt. In Deutschland wurde Anfang 2022 die Luxemburger Commerz Real Fund Management S.\u00e0.r.l. vom Landgericht Stuttgart (36 O 92\/21 KfH) unter Strafandrohung von 60.000 Euro abgemahnt, ihre irref\u00fchrende Werbung f\u00fcr Nachhaltigkeitsfonds zu unterlassen. Sie hatte mit einer konkreten Auswirkung der Geldanlage in den beworbenen Fonds auf den pers\u00f6nlichen CO\u2082-Fu\u00dfabdruck geworben.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">El CSDDD formar\u00e1 el marco del CSRD y la taxonom\u00eda de la UE<\/h2>\n\n\n\n<p>El 23 de febrero de 2022, la Comisi\u00f3n Europea fue la primera instituci\u00f3n de la UE en presentar la propuesta de <strong>Directiva sobre la diligencia debida en materia de sostenibilidad de las empresas (<a href=\"https:\/\/cubeconcepts.de\/es\/csddd\/\">CSDDD<\/a>)<\/strong> publicada. El objetivo de esta propuesta es obligar jur\u00eddicamente a las empresas que operan en la UE a cumplir <strong>Derechos humanos y normas de protecci\u00f3n del medio ambiente<\/strong> en su global <strong>Cadenas de suministro<\/strong> y penalizar mejor las infracciones de las normas ASG y el lavado verde. Esta propuesta representa un paso importante hacia pr\u00e1cticas empresariales sostenibles en condiciones europeas armonizadas y complementa la normativa existente y otras iniciativas reguladoras en curso, como la Directiva sobre informes de sostenibilidad empresarial (CSRD) con su <a href=\"https:\/\/cubeconcepts.de\/es\/ley-de-energia\/csrd-berichtspflicht-klimaplaene\/\">Obligaci\u00f3n de notificaci\u00f3n del CSRD<\/a> y el <a href=\"https:\/\/cubeconcepts.de\/es\/la-taxonomia-de-la-ue\/\">Reglamento de la UE sobre taxonom\u00eda<\/a>. Sie soll ab Mitte 2029 f\u00fcr Unternehmen mit mehr als 5.000 Besch\u00e4ftigten und mehr als 1,5 Mrd. Umsatz gelten. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Normalizaci\u00f3n europea para 2026<\/h2>\n\n\n\n<p>Por lo tanto, el CDSD vincula el <strong>Obligaci\u00f3n de notificaci\u00f3n del CSRD<\/strong> con el <strong>Taxonom\u00eda<\/strong> y se esfuerza por armonizar la normativa. Die CSDDD hat die EU im Februar 2026 mit in die Ver\u00f6ffentlichung der\u00a0<strong>Richtlinie 2026\/470 (Omnibus-\u00c4nderungsrichtlinie)<\/strong> aufgenommen. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Puntos clave de la CDSD contra las violaciones de los principios ASG y el lavado verde<\/h2>\n\n\n\n<p>Se exigir\u00e1 a las empresas, filiales y directivos que identifiquen, informen y minimicen o eliminen los impactos negativos de sus actividades empresariales sobre el medio ambiente y los derechos humanos a lo largo de toda la cadena de valor. Las grandes empresas deben desarrollar una estrategia empresarial que cumpla el Acuerdo de Par\u00eds sobre el Clima y los Estados miembros de la UE est\u00e1n estableciendo autoridades de supervisi\u00f3n y creando una red europea para emitir directivas y <strong>Multas<\/strong> coordinarse mejor. Los perjudicados tambi\u00e9n pueden <strong>derecho civil<\/strong> <strong>contra las empresas responsables<\/strong> proceder.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">El CSDD como espada m\u00e1s afilada <\/h2>\n\n\n\n<p>Las recientes multas a DWS Group y Goldman Sachs por violaciones de las normas ASG y lavado verde demuestran que <strong>las autoridades adoptan medidas m\u00e1s estrictas<\/strong>. La UE tiene previsto introducir la Directiva sobre Diligencia Debida en materia de Sostenibilidad Empresarial (DDDSE) para obligar a las empresas a cumplir las normas medioambientales y de derechos humanos en sus cadenas de suministro y crear una superestructura vinculante para las directrices existentes. <strong>Las grandes empresas deben desarrollar estrategias ya<\/strong>para cumplir los acuerdos de protecci\u00f3n del clima de Par\u00eds. Las peque\u00f1as empresas se ver\u00e1n menos afectadas.
