Both systems run in parallel and affect the same emission sources, but pursue different regulatory logics (cap-and-trade at the member state level vs. price control at the emitter level). Starting in 2028, only the additional certificate trading for emissions from building heating and road transport will begin, which in Germany is still regulated by the DEHSt/nEHS until the end of 2027. Each AEA corresponds to one tonne of CO₂ equivalent that a state is permitted to emit in the ESR sectors in a given year. The number of AEAs decreases along a linear trajectory path down to the 2030 target value.

The initial fixing of the AEAs took place in Implementing Decision (EU) 2020/2126. It was only after the 2023 amendment for the years 2023–2025 that the EU also adjusted them. The AEA values for 2026–2030 will only be finally determined in 2026—following a comprehensive review of member states' emission data from the years 2021–2023, which was completed in March 2026.

If a state's annual EEA budget is insufficient, several flexibility mechanisms:

BankingIf a Member State emits less than its AEA allocation, it can transfer the surplus to subsequent years.

Borrowing: If the limit is exceeded, a country may draw a limited amount from the following year’s AEA allocation (through 2025: max. 7.5 %; starting in 2026: max. 5 % per year).

Trading: Member States may buy and sell AEAs among themselves (starting in 2026: up to 15 % of the annual allocation).

ETS-FlexibilityNine countries with particularly high targets or without free ETS-1 allocation in 2013 (Belgium, Denmark, Ireland, Luxembourg, Malta, the Netherlands, Austria, Finland, Sweden) are permitted to cancel a limited number of ETS-1 allowances and have them counted as AEAs. Germany is not one of these nine states.

LULUCFCreditingUp to 225 million tonnes of CO₂ equivalent from net land use (LULUCF) sinks can be credited towards ESR targets across the EU.

What happens if the target is missed?

If a Member State exceeds its ESD budget after exhausting all flexibilities, the excess emission quantity is multiplied by a factor of multiplied by 1.08 and charged to the following year as an additional obligation. In addition, the affected state must submit a corrective action plan to the EU Commission.

Practically speaking, this means: If a country permanently misses its targets, it must purchase AEAs from surplus states—a financial transfer between member states, not a traditional regulatory fine. As CUBE CONCEPTS already explained in its article on Germany's ESR target miss, the frequently cited “climate fine” is therefore more precisely understood as a market mechanism: in the event of persistent target failure, Germany would have to acquire emission rights from states that exceeded their targets—financed from the federal budget.

A final compliance check for the entire 2021–2030 period will take place in 2032. In addition, states with structural difficulties can rely on a Safety reserve of up to 105 million t CO₂ equivalent access – however, not until 2032, as a last resort and tied to strict conditions (including exceeding targets in the preceding period 2013–2020).

Why the ESR is relevant for the private sector

Transport and buildings are the two biggest drivers to make German 2030 Climate Goals to be achieved. Exactly these sectors are at the center of the regulatory acceleration that has been observed in recent years:

Solar mandates for commercial properties (German Works Constitution Act and previous state-level regulations) directly target building emissions in the ESR sense.

The transition from GEG to GMG tightens energy requirements for existing and new buildings.

ESG scoring of real estate climate pathway compliance is moving more into the focus of institutional investors – partly because national ESR target pathways are increasingly being incorporated into risk analyses.

Starting in 2028, with ETS 2 an additional pricing tier for building heat and fuels, which further increases regulatory pressure on electrification and sector coupling – and thus on PV and storage solutions.

For investors and asset operators, taking a look at the ESR is therefore worthwhile not only out of climate policy interest: it is one of the drivers behind the tightening of solar mandates, renovation requirements, and carbon pricing, which are increasingly strengthening the business case for PV, BESS, and sector-coupling solutions.

What happens after 2030?

The national targets under the ESR and the LULUCF Regulation expire in 2030 – there is no automatic extension. A follow-up framework is in the works, but has not yet been finally adopted.

The background is the new EU 2040 climate target: In July 2025, the European Commission proposed an amendment to the European Climate Law that would set a binding target to reduce net greenhouse gas emissions by 90 % by 2040 compared to 1990 levels. In December 2025, the Parliament and the Council provisionally agreed on this target as the basis for the climate architecture of the coming decade.

To develop the post-2030 framework, the Commission has launched two public consultations—on the role of national climate targets and flexibilities, as well as on the potential use of international emission credits. Both ran until May 4, 2026. In parallel, a consultation is underway on the revision of the Governance Regulation, which forms the overarching legal framework for EU climate and energy policy.

It is currently open whether there will be binding national percentage targets again according to the ESR logic or whether governance will be carried out more strongly through already existing mechanisms such as ETS 2. A Commission proposal for the post-2030 framework is still pending.

FAQ: Effort Sharing Regulation

<details class="wp-block-details is-layout-flow wp-block-details-is-layout-flow">
What is the difference between ESR and ETS 1/2?

The ESR sets national emission targets for member states in sectors outside emissions trading (transport, buildings, agriculture, small industry, waste).
