Since then, the process has evolved further \u2013 and the central question in conversations with industrial customers is now almost always: When can I expect this, and what do I need to prepare in the meantime?<\/p>\n\n\n\n

This post provides a clear answer based on the current procedural status (May 2026) and derives concrete recommendations for operators of large-scale battery storage systems.<\/p>\n\n\n\n

The official schedule of the Federal Network Agency<\/h2>\n\n\n\n

The MiSpeL determination is not a single legislative act, but a multi-stage regulatory process. The Federal Network Agency (BNetzA) carries it out based on its powers under Section 85d of the EEG 2023. Here's an overview of all the essential milestones:<\/p>\n\n\n\n

Crucial <\/strong>The statutory deadline runs until June 30, 2026. Industry associations such as the bne (Federal Association for the New Energy Economy) are calling for an earlier effective date in the first half of 2026 to cushion peak feed-in in the summer of 2026. Whether the BNetzA will fully exhaust the deadline is still open at this time (May 2026).<\/p>\n\n\n\n

What \u201cfinality\u201d really means here \u2013 an important distinction<\/h2>\n\n\n\n

Many market participants equate \u201clegal force of the determination\u201d with \u201cimmediately applicable.\u201d This is a mistake that can lead to miscalculations in investment planning.<\/p>\n\n\n\n
