S <strong>Z\u00e1kon o modernizaci budov (ZMB)<\/strong> vytv\u00e1\u0159\u00ed spolkov\u00e1 vl\u00e1da poprv\u00e9 jednotn\u00fd z\u00e1klad \u2013 a rozhoduj\u00edc\u00ed paragraf se jmenuje <strong>\u00a7 106 GModG<\/strong>. Od 1. ledna 2027 plat\u00ed celost\u00e1tn\u011b. Kdo stav\u00ed \u010di renovuje komer\u010dn\u00ed nemovitosti nebo je dr\u017e\u00ed, mus\u00ed nyn\u00ed jednat.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Co je GModG \u2013 a pro\u010d p\u0159ich\u00e1z\u00ed \u00a7 106?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Na str\u00e1nk\u00e1ch <a href=\"https:\/\/cubeconcepts.de\/cz\/vom-geg-zum-gmg\/\" type=\"post\" id=\"27258\">Z\u00e1kon o modernizaci budov<\/a> nahrazuje st\u00e1vaj\u00edc\u00ed n\u011bmeck\u00fd z\u00e1kon o energetice budov (GEG) a prov\u00e1d\u00ed mimo jin\u00e9 evropskou sm\u011brnici o energetick\u00e9 n\u00e1ro\u010dnosti budov (<a href=\"https:\/\/cubeconcepts.de\/cz\/smernice-eu-o-stavebnictvi\/\" type=\"post\" id=\"20617\">EPBD<\/a>) se prom\u00edtly do n\u00e1rodn\u00edho pr\u00e1va. EU stanovila, \u017ee \u010dlensk\u00e9 st\u00e1ty mus\u00ed zav\u00e9st z\u00e1vazn\u00e9 po\u017eadavky na sol\u00e1rn\u00ed energii pro budovy \u2013 a spolkov\u00e1 vl\u00e1da tyto po\u017eadavky v kv\u011btnu 2026 vt\u011blila do konkr\u00e9tn\u00edch paragraf\u016f v n\u00e1vrhu GModG.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 106 GModG se p\u0159itom st\u00e1v\u00e1 <strong>centr\u00e1ln\u00ed regulace pro sol\u00e1rn\u00ed energii na budov\u00e1ch<\/strong> v N\u011bmecku. Je pova\u017eov\u00e1n za technologicky otev\u0159en\u00fd pro <a href=\"https:\/\/cubeconcepts.de\/cz\/fotovoltaika\/\" type=\"page\" id=\"28902\">Fotovoltaika<\/a> a sol\u00e1rn\u00ed term\u00e1ln\u00ed energie, vs\u00e1z\u00ed na postupn\u00e9 zav\u00e1d\u011bn\u00ed a definuje jasn\u00e9 prahov\u00e9 hodnoty \u2013 podle typu budovy a u\u017eitn\u00e9 plochy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pro komer\u010dn\u00ed nemovitosti je to nejrelevantn\u011bj\u0161\u00ed novinka cel\u00e9ho z\u00e1kona.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">V\u00edce\u00farov\u0148ov\u00fd pl\u00e1n: Kdy plat\u00ed co pro komer\u010dn\u00ed nemovitosti?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 106 GModG p\u0159edpokl\u00e1d\u00e1 postupn\u00e9 zav\u00e1d\u011bn\u00ed, aby se nezat\u00ed\u017eil stavebn\u00ed pr\u016fmysl. Kdo bude brzy komplexn\u011b sanovat svou pr\u016fmyslovou budovu o u\u017eitn\u00e9 plo\u0161e od 500 m\u00b2, bude muset od roku 2028 sou\u010dasn\u011b z\u0159\u00eddit nebo nechat z\u0159\u00eddit sol\u00e1rn\u00ed za\u0159\u00edzen\u00ed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sol\u00e1rn\u00ed p\u0159ipravenost: Povinnost za\u010d\u00edn\u00e1 u\u017e p\u0159i pl\u00e1nov\u00e1n\u00ed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u010casto podce\u0148ovan\u00fd aspekt \u00a7 106 GModG se net\u00fdk\u00e1 samotn\u00e9 instalace, ale <strong>Pl\u00e1nov\u00e1n\u00ed<\/strong>. Kdo to ignoruje, riskuje drah\u00e9 dod\u011bl\u00e1vky nebo si znemo\u017en\u00ed ekonomicky smyslupln\u00fd provoz za\u0159\u00edzen\u00ed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pro stavebn\u00edky, kte\u0159\u00ed dnes \u017e\u00e1daj\u00ed o stavebn\u00ed povolen\u00ed nebo rozv\u00edjej\u00ed projekty, plat\u00ed: po\u017eadavek na p\u0159ipravenost na sol\u00e1rn\u00ed energii nen\u00ed n\u011bco \"nav\u00edc\" \u2013 je to z\u00e1konem ukotven\u00fd pl\u00e1novac\u00ed z\u00e1klad.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">V\u00fdjimky a dolo\u017eky o zm\u00edrn\u011bn\u00ed tvrdosti<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Z\u00e1kon zn\u00e1 situace, kdy povinnost instalace odpad\u00e1. Hlavn\u00ed d\u016fvody pro v\u00fdjimku jsou:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Pam\u00e1tkov\u00e1 ochrana<\/strong> Budovy pod pam\u00e1tkovou ochranou jsou z\u00e1sadn\u011b vyjmuty, pokud pam\u00e1tkov\u00fd \u00fa\u0159ad nepovol\u00ed v\u00fdjimku.<\/li>\n\n\n\n<li><strong>Technick\u00e1 nemo\u017enost:<\/strong> Pokud instalace nen\u00ed provediteln\u00e1 z konstruk\u010dn\u00edch, statick\u00fdch nebo technick\u00fdch d\u016fvod\u016f.<\/li>\n\n\n\n<li><strong>Hospod\u00e1\u0159sk\u00e1 nep\u0159ijatelnost<\/strong> Kdy\u017e n\u00e1klady neodpov\u00eddaj\u00ed dosa\u017eiteln\u00fdm p\u0159\u00ednos\u016fm.<\/li>\n\n\n\n<li><strong>Vyhnout se dvoj\u00edmu zat\u00ed\u017een\u00ed:<\/strong> Budovy, kter\u00e9 podl\u00e9haj\u00ed povinn\u00e9 rozs\u00e1hl\u00e9 rekonstrukci podle \u00a7 40 GModG, jsou do\u010dasn\u011b osvobozeny od povinnosti instalace sol\u00e1rn\u00edch panel\u016f \u2013 aby se majitel\u00e9 ochr\u00e1nili p\u0159ed simult\u00e1nn\u00edm dvoj\u00edm zat\u00ed\u017een\u00edm.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pro vlastn\u00edky a spr\u00e1vce aktiv\u016f to znamen\u00e1: Pau\u0161\u00e1ln\u00ed odkazov\u00e1n\u00ed na v\u00fdjimky nen\u00ed mo\u017en\u00e9. D\u016fvody mus\u00ed b\u00fdt zdokumentov\u00e1ny a v p\u0159\u00edpad\u011b pochybnost\u00ed prok\u00e1z\u00e1ny. V\u010dasn\u00e9 prov\u011b\u0159en\u00ed \u2013 ide\u00e1ln\u011b v r\u00e1mci technick\u00e9 prov\u011brky (due diligence) \u2013 je smyslupln\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mo\u017enost realizace t\u0159et\u00ed stranou<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u00a7 106 GModG v\u00fdslovn\u011b dovoluje, aby povinnost plnily t\u0159et\u00ed osoby \u2013 nap\u0159\u00edklad prost\u0159ednictv\u00edm <a href=\"https:\/\/cubeconcepts.de\/cz\/sluzby\/uzavirani-smluv-s-krychlemi\/\" type=\"page\" id=\"168\">Uzav\u00edr\u00e1n\u00ed smluv<\/a>. To znamen\u00e1, \u017ee majitel\u00e9 nemus\u00ed nutn\u011b investovat sami. Poskytovatel slu\u017eby Contracting se postar\u00e1 o pl\u00e1nov\u00e1n\u00ed, financov\u00e1n\u00ed, instalaci a provoz za\u0159\u00edzen\u00ed \u2013 majitel tak spln\u00ed svou z\u00e1konnou povinnost, ani\u017e by musel vynakl\u00e1dat vlastn\u00ed kapit\u00e1l. Jedn\u00e1 se o vhodn\u00fd model zejm\u00e9na pro majitele st\u00e1vaj\u00edc\u00edch nemovitost\u00ed a spr\u00e1vcovsk\u00e9 spole\u010dnosti s omezen\u00fdm rozpo\u010dtem na investi\u010dn\u00ed v\u00fddaje nebo se slo\u017eitou vlastnickou strukturou.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">St\u00e1tn\u00ed pr\u00e1vo z\u016fst\u00e1v\u00e1 \u2013 a m\u016f\u017ee b\u00fdt p\u0159\u00edsn\u011bj\u0161\u00ed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">GModG zav\u00e1d\u00ed celost\u00e1tn\u00ed minimum, ale ne celost\u00e1tn\u00ed maximum. V odstavci 4 je v\u00fdslovn\u011b stanoveno, \u017ee st\u00e1ty mohou prost\u0159ednictv\u00edm st\u00e1tn\u00edch z\u00e1kon\u016f zav\u00e9st dal\u0161\u00ed po\u017eadavky. St\u00e1vaj\u00edc\u00ed p\u0159\u00edsn\u011bj\u0161\u00ed p\u0159edpisy \u2013 nap\u0159\u00edklad v B\u00e1densku-W\u00fcrttembersku, NRW, Hamburku nebo Bavorsku \u2013 z\u016fst\u00e1vaj\u00ed pln\u011b v platnosti.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To m\u00e1 pro majitele celost\u00e1tn\u00edch portfoli\u00ed d\u016fle\u017eit\u00fd d\u016fsledek: celost\u00e1tn\u00ed sol\u00e1rn\u00ed povinnost podle \u00a7 106 GModG je <strong>nov\u00fd minim\u00e1ln\u00ed standard<\/strong>.
