Krom\u011b toho byla spole\u010dnosti ulo\u017eena pokuta ve v\u00fd\u0161i \u0161esti milion\u016f eur za nedostate\u010dn\u00e9 kontroly pran\u00ed \u0161pinav\u00fdch pen\u011bz. Jen n\u00e1klady na pr\u00e1vn\u00ed zastoupen\u00ed spole\u010dnosti v t\u00e9to kauze dosud dos\u00e1hly p\u0159ibli\u017en\u011b 39 milion\u016f eur a na burze ztratila spole\u010dnost hodnotu jedn\u00e9 miliardy eur. K tomu je t\u0159eba p\u0159ipo\u010d\u00edtat ztr\u00e1tu dobr\u00e9ho jm\u00e9na a p\u0159\u00edpadn\u00e9 n\u00e1roky investor\u016f na n\u00e1hradu \u0161kody. V N\u011bmecku skupinu DWS st\u00e1le vy\u0161et\u0159uje org\u00e1n finan\u010dn\u00edho dohledu BaFin a st\u00e1tn\u00ed zastupitelstv\u00ed. Mauricio Vargas, finan\u010dn\u00ed expert Greenpeace, vysv\u011btlil: \"Rozhodnut\u00ed soudu jasn\u011b ukazuje, \u017ee greenwashing a klam\u00e1n\u00ed spot\u0159ebitele nejsou ban\u00e1ln\u00edmi trestn\u00fdmi \u010diny.\"<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Org\u00e1ny p\u0159ij\u00edmaj\u00ed d\u016frazn\u011bj\u0161\u00ed opat\u0159en\u00ed proti poru\u0161ov\u00e1n\u00ed ESG a greenwashingu<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Spojen\u00e9 st\u00e1ty tak v sou\u010dasn\u00e9 dob\u011b postupuj\u00ed p\u0159\u00edsn\u011bji ne\u017e v p\u0159edchoz\u00edm roce, kdy americk\u00e1 velk\u00e1 banka Goldman Sachs <strong>4 miliony dolar\u016f<\/strong> odsouzen. Ve sv\u00e9 jednotce Asset Management na Wall Street dva sv\u00e9 fondy propagovali jako \u201eESG-kompatibiln\u00ed\u201c, a\u010dkoli ani jeden z nich nestanovil ESG standardy ani neexistovaly \u017e\u00e1dn\u00e9 pokyny nebo strategie. Goldman Sachs je bez dal\u0161\u00edho prohl\u00e1sil za \u201ezelen\u00e9\u201c a \u201eudr\u017eiteln\u00e9\u201c fondy ESG. V N\u011bmecku byla na po\u010d\u00e1tku roku 2022 lucembursk\u00e1 spole\u010dnost Commerz Real Fund Management S.\u00e0.r.l. zemsk\u00fdm soudem ve Stuttgartu (36 O 92\/21 KfH) pod hrozbou pokuty 60 000 EUR napomenuta, aby upustila od klamav\u00e9 reklamy na fondy udr\u017eitelnosti. Propagovali se s konkr\u00e9tn\u00edm dopadem investice do propagovan\u00fdch fond\u016f na osobn\u00ed uhl\u00edkovou stopu.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">CSDDD tvo\u0159\u00ed r\u00e1mec pro CSRD a taxonomii EU<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Dne 23. \u00fanora 2022 p\u0159edlo\u017eila Evropsk\u00e1 komise jako prvn\u00ed instituce EU n\u00e1vrh na vytvo\u0159en\u00ed tzv. <strong>Sm\u011brnice o n\u00e1le\u017eit\u00e9 p\u00e9\u010di v oblasti udr\u017eitelnosti podnik\u016f (<a href=\"https:\/\/cubeconcepts.de\/cz\/csddd\/\">CSDDD<\/a>)<\/strong> zve\u0159ejn\u011bno. C\u00edlem tohoto n\u00e1vrhu je pr\u00e1vn\u011b zav\u00e1zat spole\u010dnosti p\u016fsob\u00edc\u00ed v EU, aby dodr\u017eovaly <strong>Normy v oblasti lidsk\u00fdch pr\u00e1v a ochrany \u017eivotn\u00edho prost\u0159ed\u00ed<\/strong> v jejich glob\u00e1ln\u00edm <strong>Dodavatelsk\u00e9 \u0159et\u011bzce<\/strong> a l\u00e9pe postihovat poru\u0161ov\u00e1n\u00ed ESG a greenwashing. Tento n\u00e1vrh p\u0159edstavuje d\u016fle\u017eit\u00fd krok sm\u011brem k udr\u017eiteln\u00fdm obchodn\u00edm postup\u016fm v harmonizovan\u00fdch evropsk\u00fdch podm\u00ednk\u00e1ch a dopl\u0148uje st\u00e1vaj\u00edc\u00ed p\u0159edpisy a dal\u0161\u00ed prob\u00edhaj\u00edc\u00ed regula\u010dn\u00ed iniciativy, jako je sm\u011brnice o pod\u00e1v\u00e1n\u00ed zpr\u00e1v o udr\u017eitelnosti podnik\u016f (CSRD) s jej\u00edmi <a href=\"https:\/\/cubeconcepts.de\/cz\/energeticky-zakon\/plany-v-oblasti-klimatu-ohlasovaci-povinnost-csrd\/\">Oznamovac\u00ed povinnost CSRD<\/a> a <a href=\"https:\/\/cubeconcepts.de\/cz\/taxonomie-eu\/\">Na\u0159\u00edzen\u00ed EU o taxonomii<\/a>. M\u00e1 platit od poloviny roku 2029 pro spole\u010dnosti s v\u00edce ne\u017e 5 000 zam\u011bstnanci a obratem p\u0159es 1,5 miliardy. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Evropsk\u00e1 standardizace do roku 2026<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">CSDDD proto propojuje <strong>Oznamovac\u00ed povinnost CSRD<\/strong> s <strong>Taxonomie<\/strong> a usiluje o harmonizaci p\u0159edpis\u016f. Celkov\u011b by spole\u010dnosti m\u011bly o\u010dek\u00e1vat, \u017ee <strong>Po\u017eadavky na ESG se st\u00e1le zvy\u0161uj\u00ed <\/strong>a <strong>Je\u0161t\u011b intenzivn\u011bj\u0161\u00ed vym\u00fdv\u00e1n\u00ed zelen\u011b <\/strong>. I v n\u00e1vrhu sm\u011brnice EU o environment\u00e1ln\u00edch tvrzen\u00edch (Green Claims-RL), zve\u0159ejn\u011bn\u00e9m 22. b\u0159ezna 2023, se jde podobn\u00fdm sm\u011brem. CSDDD EU zve\u0159ejnila v \u00fanoru 2026, mj. p\u0159i zve\u0159ejn\u011bn\u00ed&nbsp;<strong>Sm\u011brnice 2026\/470 (omnibusov\u00e1 zm\u011bnov\u00e1 sm\u011brnice)<\/strong> zaznamen\u00e1no. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Kl\u00ed\u010dov\u00e9 body CSDDD proti poru\u0161ov\u00e1n\u00ed ESG a greenwashingu<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Spole\u010dnosti, dce\u0159in\u00e9 spole\u010dnosti a veden\u00ed budou povinny identifikovat, hl\u00e1sit a minimalizovat nebo eliminovat negativn\u00ed dopady sv\u00fdch obchodn\u00edch aktivit na \u017eivotn\u00ed prost\u0159ed\u00ed a lidsk\u00e1 pr\u00e1va v cel\u00e9m hodnotov\u00e9m \u0159et\u011bzci. Velk\u00e9 spole\u010dnosti mus\u00ed vypracovat obchodn\u00ed strategii, kter\u00e1 bude v souladu s pa\u0159\u00ed\u017esk\u00fdmi dohodami o ochran\u011b klimatu, a \u010dlensk\u00e9 st\u00e1ty EU z\u0159izuj\u00ed dozorov\u00e9 org\u00e1ny a evropskou s\u00ed\u0165, kter\u00e1 bude vyd\u00e1vat sm\u011brnice a <strong>Pokuty<\/strong> l\u00e9pe koordinovat. EU pl\u00e1nuje zav\u00e9st sm\u011brnici o n\u00e1le\u017eit\u00e9 p\u00e9\u010di v oblasti udr\u017eitelnosti podnik\u016f (CSDDD), kter\u00e1 by donutila podniky dodr\u017eovat normy v oblasti \u017eivotn\u00edho prost\u0159ed\u00ed a lidsk\u00fdch pr\u00e1v v jejich dodavatelsk\u00fdch \u0159et\u011bzc\u00edch a vytvo\u0159ila z\u00e1vaznou nadstavbu pro st\u00e1vaj\u00edc\u00ed pokyny. <strong>Velk\u00e9 spole\u010dnosti mus\u00ed vypracovat strategie ji\u017e nyn\u00ed<\/strong>s c\u00edlem dodr\u017eet pa\u0159\u00ed\u017esk\u00e9 dohody o ochran\u011b klimatu.
